The Old Law in South Carolina:

The 5% ABW cap appears twice in the South Carolina Code. In Chapter 21 of Title 12 on Taxation (§12-21-1010) and Chapter 4 of Title 61 (§12-21-1010) addressing the regulation of alcoholic beverages. In both sections, the definition of beer is basically the same:

"The word "beer" shall mean all beers, ales, porter and other similar malt or fermented beverages containing not more than five per cent of alcohol by weight."

Pop the Cap SC's mission is simple: to lift the 5% alcohol cap, allowing South Carolina to join forty-five other states free of this archaic restriction.
